Position and Bio

Jeff MacKie-Mason has prepared economic analyses and testimony for antitrust and related proceedings since 1982. He first testified as an expert in Federal District Court in 1989; since then he has testified in court at least ten times, and has submitted expert reports, affidavits, declarations and/or given depositions in over 25 cases.

MacKie-Mason specializes in technology cases. His clients have included Sun Microsystems, Qwest Communications, Hewlett-Packard, Masimo Corp., AT&T, America Online, Compuware, Covad, GO Computer, Telstra (Australia), Intergraph, SBC Communications, GTE, EDS, Northwest Airlines, Office Depot and Valassis. He has testified for parties in other cases involving Microsoft, IBM, Kodak, Xerox, Electronic Arts, Ricoh, Prime Computer, News America, and others.

After more than a decade as sole proprietor of a small firm, MacKie-Mason was a founding partner of ApplEcon LLC in 2001. He was the first Managing Partner, from 2001-2008.

Some of his prominent engagements include:

  • Plaintiff's expert on liability in ITS v. Kodak, with a successful verdict at trial and on appeal, in one of the most prominent technology antitrust cases of the past 20 years.
  • Plaintiff's expert on causation and damages in Lingo et al. v. Microsoft, resulting in a $1.1 billion settlement on behalf of California consumers.
  • Defendant's expert on liability in Tricom v. EDS, with a successful verdict at trial and on appeal.
  • Intervenor's expert in successful opposition to a proposed nationwide settlement of consumer claims against Microsoft. Demonstrated that proposed settlement was worth about $0.05 per dollar of likely damages. The Court disapproved the settlement.
  • Plaintiff's expert on liability in Compuware v. IBM. Case settled during trial, for $400 million.
  • Defendant's expert on damages in The Service Source v. Office Depot, with a successful verdict at trial and on appeal.
  • Plaintiff's expert on liability in Valassis Communications v. News America Corp., with a successful verdict at state trial for $300 million, and a final settlement of claims in three separate cases (one federal, two state) for $500 miillion, a joint distribution agreement, and an injunction.
